<h4 class="wp-block-heading"><strong><mark style="color:#043755" class="has-inline-color"><a href="https://www.monaqleasing.sk/" target="_blank" rel="noopener">Cena elektriny</a> sa prepadla do záporných čísel</mark></strong></h4>

<p class="wp-block-paragraph">Over the past calendar year, the price of electricity generated on sunny days has increasingly approached <strong>negative values</strong>. To build a solar power plant today without a <strong>guaranteed</strong> off-take and a guaranteed price under a PPA contract carries a high <strong>risk</strong> to the project&#8217;s payback. </p>

<p class="wp-block-paragraph"><a href="https://www.ulclegal.com/bulletin-pro-bono/">V tomto článku</a> preto preberieme <strong>niektoré právne aspekty</strong> využitia solárnej elektriny na <strong>ťažbu</strong> krypto aktív.</p>

<p class="wp-block-paragraph">Crypto asset mining has become very <strong>attractive</strong> in recent days and there are devices on the market that can already consume electricity and generate crypto assets <strong>profitably</strong> at <strong>today&#8217;s</strong> electricity prices.</p>

<h4 class="wp-block-heading"><strong><mark style="color:#043755" class="has-inline-color">Potreba CE certifikácie</mark></strong></h4>

<p class="wp-block-paragraph">The installation and operation of cryptoasset mining equipment is <strong>not</strong> regulated in any way in Slovakia as long as the wiring of the equipment itself meets the legal and technical requirements for <strong>electrical equipment</strong>. From the perspective of the law, mining equipment is governed by the same rules as <strong>any other</strong> electrical appliance. </p>

<p class="wp-block-paragraph">In this respect, it should be pointed out in particular that cryptocurrency mining equipment needs the <strong>relevant CE certificate</strong> attesting the conformity of the product with the legal and technical regulations in the European Union, to be sold legally in the European Union market. Many mining devices <strong>do not comply with</strong> this requirement and are therefore it is <strong>illegal</strong> to sell them in the EU. Nevertheless, it is in fact possible <strong>to import</strong> such equipment from abroad.  </p>

<h4 class="wp-block-heading"><strong><mark style="color:#043755" class="has-inline-color">Prevádzka iba (najmä) počas slnečných hodín</mark></strong></h4>

<p class="wp-block-paragraph">An unique challenge is to connect the mining equipment to the solar power plant in such a way that mining <strong>only</strong> takes place during hours when there is <strong>enough electricity generated from the sun</strong>, as cryptocurrency mining is not always profitable at today&#8217;s electricity prices. The mining facilities themselves <strong>do not allow</strong> such a connection and therefore their operation must be controlled by <strong>other devices</strong> that can be programmed with the appropriate logic. </p>

<p class="wp-block-paragraph">Up to date, we have <strong>(i) first of all</strong> tried cooperation with several control unit providers, mainly in the form of <strong>PLC</strong> (Programmable Logic Controller) computers. These devices measure the output of the solar panels, either directly via modbus <strong>RS485 </strong>communication with the inverter to which the solar panels are connected, or indirectly via a separate <strong>smartmeter</strong> that measures the output of the solar panels at the inverter output. </p>

<p class="wp-block-paragraph">The PLC unit then <strong>physically switches on the</strong> individual ASIC mining devices via a <strong>contactor</strong>, or sends a signal to the <strong>Arduino</strong> computer, which switches the individual mining devices on or off via <strong>a software API</strong>.</p>

<p class="wp-block-paragraph">Control devices wired in this way are relatively <strong>inexpensive</strong>, exhibit high <strong>reliability</strong>, and are <strong>simple</strong> enough to exhibit low failure rates.</p>

<p class="wp-block-paragraph"><strong>The second (ii)</strong> option for controlling the operation of mining equipment to use only electricity generated from the sun is the <strong>use of batteries</strong>, which store unused electricity during the sunny day and are used for mining even after sunset or during cloudy weather. Such an arrangement is <strong>considerably more expensive</strong> because of the relatively high cost of batteries to store sufficient electricity. A separate way of using batteries to store electricity from the sun is to use a <strong>virtual battery</strong> service, which is also offered by some companies on the Slovak market. However, with a virtual battery service, it should be taken into account that when drawing electricity from a virtual battery, the <strong>price of</strong> electricity <strong>distribution still has to be paid</strong>.   </p>

<p class="wp-block-paragraph"><strong>The third (iii)</strong> solution is to use <strong>only</strong> mining equipment that is <strong>profitable</strong> in mining cryptocurrency even after paying the <strong>current price of</strong> electricity. At today&#8217;s electricity prices and the price of some crypto assets, there are several facilities on the market that can profitably mine the relevant cryptocurrencies <strong>nonstop</strong>, but their disadvantage is the <strong>high acquisition</strong> cost. It is therefore important to consider over what period of time and at what market prices for electricity and cryptocurrencies the <strong>return on</strong> the investment in the mining equipment will be secured.  </p>

<p class="wp-block-paragraph">In this context, it is worth pointing out that some electricity sellers are flexible enough to provide <strong>very favorable terms</strong> for the sale of electricity to mining installations. Several of our clients have been able to build <strong>very profitable systems of</strong> mining facilities using the surplus solar energy generated by their solar panels, thanks to negotiated favorable electricity prices. </p>

<p class="wp-block-paragraph">In <strong>(iv) the fourth</strong> option of using cryptocurrency mining facilities, it is possible to <strong>sell</strong> electricity from solar panels (on the electricity market, e.g. OKTE) when electricity prices <strong>are high</strong> and to <strong>use</strong> own electricity from solar panels for mining when electricity prices <strong>are low</strong>, or to buy electricity on the exchange and use it for <strong>cryptocurrency mining</strong>.</p>

<p class="wp-block-paragraph">Such operation control can also be provided by <strong>a PLC computer</strong> in conjunction with an <strong>Arduino</strong> computer, at very low set-up costs. However, this option requires access to current electricity prices via an <strong>API</strong> provided by an electricity <strong>exchange</strong> or an electricity trader. </p>

<h4 class="wp-block-heading"><strong><mark style="color:#043755" class="has-inline-color">Výroba tepla</mark></strong></h4>

<p class="wp-block-paragraph">In fact, the mining of cryptoassets itself is just a <strong>by-product of heat production</strong>. Mining produces a lot of <strong>heat</strong> when the electrical equipment is operating, and it is only by coincidence that this heat is generated when the equipment is used to <strong>calculate the relevant </strong>mathematical equations, which also results in the creation (&#8220;<strong>mining</strong>&#8220;) of the cryptocurrency. Due to the fact that in Slovakia it is necessary <strong>to heat for</strong> more than 6 months of the year, the heat generated during the mining of cryptoassets can also <strong>be utilised</strong> for <strong>heating</strong>. In most cases, it is not possible to use mining equipment directly in residential premises because they are <strong>noisy</strong>. However, they can be easily and efficiently used to heat other, <strong>commercial</strong>areas. To illustrate, some of our clients are currently having a good experience using, for example, the IceRiver AL0 to <strong>temper their garage</strong>, and as of the date of this writing, their operation is profitable even at <strong>current</strong> electricity prices, without the use of solar panels.      </p>

<h4 class="wp-block-heading"><strong><mark style="color:#043755" class="has-inline-color">Zodpovednosť za škodu a imisie</mark></strong></h4>

<p class="wp-block-paragraph">When operating mining equipment, it should be borne in mind that its operation is associated with high <strong>noise levels</strong> and <strong>temperatures</strong> well above normal operating temperatures of residential premises.</p>

<p class="wp-block-paragraph">They may therefore only be operated in <strong>premises adapted for this purpose</strong>. In particular, care must be taken to prevent <strong>fires</strong> and noise nuisance. </p>

<h4 class="wp-block-heading"><strong><mark style="color:#043755" class="has-inline-color">Daňový aspekt</mark></strong></h4>

<p class="wp-block-paragraph">The mining of cryptoassets constitutes <strong>income</strong> that must be taxed at the appropriate <strong>income / corporate tax</strong> rate. The cryptocurrency mined represents a <strong>gain</strong> when credited to a wallet owned by the operator, which is marked at <strong>the price on the date of crediting</strong> and separately each day when it is credited. </p>

<p class="wp-block-paragraph"><strong>The tax deductible cost</strong> is the <strong>price of</strong> the mining equipment, its professional <strong>installation</strong> and the price of the <strong>electricity</strong> consumed. Equipment for the extraction of crypto-assets is to be <strong>depreciated</strong> in the appropriate depreciation class according to the nature of the equipment. </p>

<p class="wp-block-paragraph"><strong>1. New tax to save the state budget</strong></p>

<p class="wp-block-paragraph">Nová <strong>daň z peňažných transakcií</strong> (transakčná daň) má ročne zobrať podnikateľom na Slovensku približne 700 mil. EUR. Táto daň sa má platiť pri <strong>uskutočnení prevodu z podnikateľského účtu inému podnikateľovi</strong>, nie však pri prijatí platby. Zasiahne teda všetky <strong>platby v prospech dodávateľov</strong>.</p>

<p class="wp-block-paragraph">Many businesses with small margins and a large number of transactions <strong>will be at risk</strong> unless their competitors have to bear the <strong>same</strong> transactional tax burden. The sectors affected will include in particular <strong>food</strong>, <strong>agriculture </strong>and all businesses that operate in a <strong>highly competitive</strong> environment. The tax is to be <strong>0.4% of the transfer amount</strong>, up to <strong>a maximum of EUR 40</strong>. Therefore, a small number of large transactions will be taxed <strong>less</strong> than many small transactions.   </p>

<p class="wp-block-paragraph">It is natural that all the most affected entrepreneurs will try to find a way <strong>to legally circumvent the tax</strong>.</p>

<p class="wp-block-paragraph"><strong>2. Cash payments will not provide a solution</strong></p>

<p class="wp-block-paragraph"><strong>Platby v hotovosti</strong> <strong>nebudú</strong> dobrým riešením. Už dnes sú <strong>zakázané</strong> aj u podnikateľov ak prevyšujú 15.000 EUR na transakciu. Pri prekročení tejto čiastky síce transakcia nebude neplatná, ale podnikateľovi hrozí pokuta. Najmä, daň bude postihovať aj <strong>výber hotovosti</strong> <strong>z účtu a bude mať vtedy sadzbu 0,8% z <a href="https://www.monaqleasing.sk/" target="_blank" rel="noopener">vyberanej sumy</a></strong>.</p>

<p class="wp-block-paragraph"><strong>Barter</strong>, i.e. the exchange of goods for goods, is likely to be a good way to circumvent the tax, but barter can only be used if both parties are supplying some mutual non-monetary consideration to each other. Such cases <strong>will be rather rare</strong>. </p>

<p class="wp-block-paragraph"><strong>3. Bank account abroad is not a solution<br /></strong></p>

<p class="wp-block-paragraph">The transaction tax will also apply to business transfers <strong>from offshore accounts</strong> or transfers using non-bank payment services, e.g. <strong>PayPal</strong>, <strong>Skrill</strong>, etc. In these cases, however, the tax will have to <strong>be calculated by the entrepreneur himself</strong>, although otherwise it will be done by the Slovak <strong>bank</strong>.  </p>

<p class="wp-block-paragraph"><strong>4. Use of cryptocurrencies</strong></p>

<p class="wp-block-paragraph">No a zostávajú nám ešte <strong><a href="https://www.ulclegal.com/kategoria-buletinu/kryptomeny/">kryptomeny</a></strong>. Kryptomeny <strong>nie sú</strong> na Slovensku považované za <strong>peniaze</strong>, ale za samostatnú majetkovú hodnotu, ktorá sa z hľadiska vecného práva riadi pravidlami pre <strong>hnuteľné veci</strong>. Takým spôsobom sú <strong>aj zdaňované</strong>.</p>

<p class="wp-block-paragraph">For each cryptocurrency transaction, the <strong>value of the cryptocurrency on the date of the transaction</strong> is treated as taxable income for <strong>income tax</strong> purposes, and the <strong>cost</strong> of acquiring the cryptocurrency may be deducted at its monetary value on the date of acquisition. But this calculation is only used for income tax purposes. </p>

<p class="wp-block-paragraph"><strong>Transaction tax does not apply to cryptocurrency and its transfers</strong>, just as it does not apply to the transfer of movable property.</p>

<p class="wp-block-paragraph">Another advantage of cryptocurrencies is the <strong>speed of their transfer</strong> to the other account. The transfer usually takes only a few minutes and can be done anytime, at night or even on the weekend, without restrictions. All you need is access to the internet.  </p>

<p class="wp-block-paragraph">However, the use of cryptocurrencies is not a one-size-fits-all solution for transaction tax. When <strong>buying </strong>cryptocurrencies with <strong>euros </strong>, transaction tax <strong>must be paid</strong>.  </p>

<p class="wp-block-paragraph">Therefore, the use of cryptocurrencies will only really make sense in relation to transaction tax <strong>if </strong>the cryptocurrency is <strong>both</strong>used to pay for goods or services by the business&#8217;s <strong>customers</strong> and, in turn, the cryptocurrency is <strong>also </strong>received by the business&#8217;s <strong>suppliers</strong>.</p>

<p class="wp-block-paragraph"><strong>5. Exchange of euro to cryptocurrency and vice versa</strong></p>

<p class="wp-block-paragraph">Using cryptocurrency as payment for suppliers may become the <strong>new standard</strong>. Today, there are many <strong>exchanges and exchange points</strong> where <strong>cryptocurrencies can be converted into euros</strong>. The whole exchange takes no more than <strong>a few minutes</strong> and the euros are in our account. The payment coming <strong>from</strong> <strong>abroad</strong>, i.e. from a foreign exchange or from a foreign exchange point where we exchange cryptocurrency back into euros, <strong>will not be subject to the transaction tax.</strong> Even if the recipient of the euros is a Slovak entrepreneur. On the other hand, if a business purchases a larger amount of cryptocurrency at one time, the transaction tax will be max. 40 EUR.    <strong>.. </strong>.
Pri každom nákupe kryptomeny za viac ako 10.000 EUR bude preto výsledná sadzba dane z transakcie <strong>menšia ako 0,4%</strong>, a kryptomenu môže následne podnikateľ používať pri menších platbách a to už bez zdanenia daňou z transakcií. </p>

<p class="wp-block-paragraph"><strong>6. Exchange rate risk</strong></p>

<p class="wp-block-paragraph">The use of cryptocurrencies will carry a <strong>high exchange rate risk</strong> unless the cryptocurrency used is <strong>pegged to the euro</strong>. The two largest cryptocurrencies pegged to the euro are <strong>EURT</strong> (Eur Tether) and <strong>EURS</strong> (Stasis Euro), but their ability to be traded is limited to <strong>certain</strong> large exchanges. </p>

<p class="wp-block-paragraph"><strong>7. Cryptocurrency scams</strong></p>

<p class="wp-block-paragraph">However, the increase in cryptocurrency transactions will also increase the <strong>number of frauds</strong>. Using cryptocurrencies requires a certain amount of <strong>experience</strong> and the ability to detect fraud before falling victim to it. </p>

<p class="wp-block-paragraph">When exchanging cryptocurrencies for euros on a <strong>large well-known exchange</strong>, the risk is not significant. However, only <strong>a few</strong> exchanges allow you <strong>to make a withdrawal in euros</strong> to a business account. Therefore, many exchanges take place on the so-called <strong>Peer to Peer (P2P) </strong>market.  </p>

<p class="wp-block-paragraph">In these transactions, the owner of the cryptocurrency finds <strong>through </strong>the marketplace someone who is willing to <strong>accept the cryptocurrency</strong> and send the owner of the cryptocurrency <strong>money</strong>, i.e. euros, back to his account. First, the owner of the cryptocurrency <strong>deposits </strong>the cryptocurrency in an <strong>escrow </strong>account organized by the marketplace. The marketplace <strong>informs </strong>the owner of euros that it has received the cryptocurrency for exchange and <strong>asks him </strong>to transfer euros to the owner of the cryptocurrency&#8217;s account. When the owner of the cryptocurrency <strong>receives the payment in his account</strong>, he <strong>confirms </strong>to the marketplace that he received the money. Subsequently, the <strong>marketplace transfers the cryptocurrency</strong> to the electronic wallet of the former euro owner.</p>

<p class="wp-block-paragraph">The above course is described in the way as the transaction should take place by design. <strong>But what</strong> if the money arrives in the account of the cryptocurrency owner and he <strong>denies </strong>receiving it? Or the money <strong>does not arrive</strong> in the cryptocurrency owner&#8217;s account, but the transferor sends <strong>fraudulent receipts</strong> that the cryptocurrency owner believes? Or if the cryptocurrency owner puts the money in <strong>someone else&#8217;s account</strong>, will the money end up there, not with the cryptocurrency owner? To whom should the marketplace administrator transfer the cryptocurrency in these cases, back to <strong>the original</strong> owner of <strong>the cryptocurrency</strong> or to the original owner of the <strong>money</strong>? The result is mostly just a cluster of problems that sometimes even lawyers don&#8217;t have to resolve. In these fraudulent transactions, the biggest problem is <strong>carrying the burden of proof</strong>. To prove that <strong>we</strong> have proceeded correctly and the <strong>other party did not</strong>.      </p>

<p class="wp-block-paragraph"><strong>8. Conclusion</strong></p>

<p class="wp-block-paragraph">There are <strong>rules</strong> that need to be followed in order to avoid <strong>becoming a victim of</strong> crypto currency trading fraud. There are multiple rules and we will review them <strong>one by one</strong>. </p>

<p class="wp-block-paragraph">It is also important to keep in mind that payments with cryptocurrencies are not free either. Buying and selling them is connected to certain costs that need to be budgeted for. </p>

<p class="wp-block-paragraph">The introduction of a transaction tax will undoubtedly increase the <strong>popularity and use of cryptocurrencies</strong>. Knowledge of cryptocurrencies and their use will be considered a normal part of financial literacy in the near future, and it will be appropriate to devote some time and effort to understanding them. </p>
